1. Promotion Period:  7 March 2023, 11:30pm Australian Eastern Daylight Time (“AEDT”) and closes on 21 April 2023, 11:59pm Australian Eastern Standard Time (“AEST”). Important Note: All dates and times listed throughout these terms and conditions are in AEDT/AEST. Entrants are solely responsible for determining the corresponding time in their respective territories.

2. Referrer Eligibility:

a) To be eligible to participate in this Promotion and secure a Reward, a referrer must:

i. Have an active Envato Elements subscription
ii. Have received a unique referral link (“Unique Link”) from Envato Elements
iii. During the Promotion Period (and subject to Clause 5(b) below), refer a genuine new/first time customer (a “Friend”) to Envato Elements using the Unique Link.

b) Employees, directors or other representatives (including affiliates) of Envato, or of any third party associated with this Promotion (including reward suppliers) are not eligible to participate in this Promotion.

3. Reward:

a) The Reward for each Eligible Referral (see Clause 4(b) below) is 1 x USD$25 digital Visa Prepaid Card capped at a maximum of 5 Rewards per Referrer.  

b) Rewards will apply to the first 2000 Eligible Referrals or until the end of the Promotion Period, whichever is the earliest. 

c) Rewards will be issued by email by our third party supplier, Tremendous, and are not redeemable for cash and cannot be exchanged. Rewards may be subject to separate terms and conditions of Tremendous(and any terms and conditions of Visa and/or other third party vendors upon use of the Reward) and to the extent of any inconsistency, the terms and conditions of Tremendous will prevail over these Promotion terms and conditions in respect of use of the Reward.

d) Rewards will be issued within four (4) weeks of the conclusion of the Promotion Period to the Referrer’s email address that they have previously registered with Envato Elements. 

4. Referral Terms

a) If you are an eligible “Referrer” the terms of this Clause 4 will apply. 

b) For a referral to be eligible for a Reward (“Eligible Referral”):

i. You must share your Unique Link with a Friend during the Promotion Period; and

ii. Your Friend must be at least 18 years old and be a new/first-time subscriber to Envato Elements, and must successfully purchase an Individual Yearly subscription to Envato Elements via your Unique Link. 

c) To avoid doubt, the following will not constitute an Eligible Referral if your Friend:

i. Is an existing Envato Elements subscriber or purchases an Individual monthly, Student, or Team subscription; or

ii. Has recently subscribed (before receiving the Unique Link) and are currently in their “free” trial period but cancel their subscription to take advantage of the Promotion Discount (defined at 5(b)). ; or

iii. Initiates a refund for their new subscription within four (4) weeks of the conclusion of the Promotion Period. 

d) You may share the Unique Link with a Friend that is a returning subscriber, but you will not be eligible for a Reward for that referral.

e) You may refer as many friends as you like, but only a maximum of 5 Eligible Referrals will be rewarded.

f) If multiple referrals are being sent, Referrers will limit the delivery of referral emails to a maximum of ten email addresses at a time.

g) Your Unique Link is for individual, personal use only and may not be used for commercial purposes (including but not limited to affiliate lead generation or on-selling of any kind). You are not permitted to alter or modify the Unique Link in any way.

h) By sharing your Unique Link with a Friend (via email or other communications), you represent that you know the friend to whom you are sending the communication, you genuinely believe they would be interested in the offer, and that, to the extent any consent is necessary, you have their consent to send the communication.

i) Each Friend you refer can only be referred once using your Unique Link. If your Friend receives more than one referral from multiple Referrers, only the sender of the referral link that is used will be eligible for a Reward. 

5. Referred Customers (Friend) Terms

a) If you are a “Friend”, the terms of this Clause 5 will apply. 

b) To be eligible to receive the 20% discount (“Promotion Discount”), a Friend must: 

i. Be a new or returning Envato Elements subscriber (ie. they cannot have an existing and active subscription or be within a free trial period);

ii. must be at least 18 years old and must successfully purchase an Individual yearly subscription directly through the Unique Link before 11:59 PM AEST Apr 21, 2023. 

c) The Promotion Discount applies to the first year of the Individual yearly subscription only. Upon expiry of the first year, the subscription will automatically renew each year at the standard pricing + any local tax, until canceled.

d) Friends must subscribe via the Unique Link shared by the Referrer for the Promotion Discount to be automatically applied at checkout.

e) The Promotion Discount can only be redeemed once per subscriber. Envato Elements reserves the right to cancel or refuse to redeem discount coupons for any reason, including the suspension of creating multiple accounts to benefit from the Promotion Discount. 

f) The Promotion Discount (and associated Unique Link) has no monetary value and can’t be exchanged, transferred, redeemed, replaced, or refunded for proper cash.

6. General

a) The Unique Link will expire at 11:59 PM AEST Apr 21, 2023. Any unused referral links shared with Friends will be forfeited at that time and the Referrer will not be eligible for further Rewards.

b) The Rewards and Promotion Discounts cannot be combined or used in conjunction with other discount codes, promotions, free trial periods or offers. 

c) Envato reserves the right not to issue any Reward or Promotion Discount, or otherwise disqualify a Referrer or Friend from participating in this promotion if that participant violates these terms and conditions (including illegal activity or suspected fraud, such as creation of multiple accounts by either Referrer or Friend), infringes the rights of any third party or otherwise tampers with the Promotion in any way. 

d) Envato may in its sole discretion, cancel or discontinue the Promotion its entirety, if there are any circumstances that mean the Promotion can’t be run as planned, this includes technical issues, hacking, natural disasters and anything else beyond our control. To avoid doubt, subject to these terms and conditions, Rewards will be issued for any Eligible Referrals submitted before the cancelation date.

e) Envato will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) in connection with this Promotion, or for personal injury suffered or sustained as a result of receiving or using a Reward, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

f) Envato accepts no responsibility or liability for any delay or failure by the third party to deliver the Reward, or any delay or failure relating to the Reward itself (including any technical delays or failures).

g) By participating in the Refer a Friend program, Referrers and Friends are agreeing to these terms and conditions as well as Envato Elements’ User Terms and Privacy Policy.
